According to Lex Machina’s 2026 Product Liability Litigation Report, more new product liability lawsuits were filed in federal district courts from 2023 through 2025 than intellectual property, labor and employment, and civil rights cases combined. During the same period, federal product liability cases resulted in more than $6.37 billion in principal damages through court-ordered awards and approved class-action settlements.

Texas was among the leading venues. The Western District of Texas recorded 555 non-MDL product liability cases between 2023 and 2025, making it the leading federal district outside California during that period.

The report also found that federal courts awarded approximately $3 billion in product liability damages in 2025. One case accounted for approximately $2.53 billion of that amount, illustrating how individual product liability cases can involve substantial damages.The plaintiffs alleged that the Ford truck featured a defective roof design that failed to provide adequate protection during a rollover accident.

She was extremely helpful, answering questions I had, and offering very useful suggestions to navigate the situation.
