Birthright Citizenship Executive Order: What You Need to Know

On January 20, 2025, Donald Trump signed an Executive Order addressing birthright citizenship in the United States. The order proposes changes that could prevent some children born in the U.S. from automatically becoming U.S. citizens if their parents are undocumented immigrants or have only temporary legal status.

For more than a century, birthright citizenship has been protected under the Fourteenth Amendment to the United States Constitution, which states that individuals born in the United States are citizens regardless of their parents’ immigration status.

At the time of writing, the Executive Order is not currently in effect because it is being challenged in several lawsuits. As a result, birthright citizenship protections remain unchanged for now. However, the courts have not yet made a final decision, and the future of this policy remains uncertain.

Who Could Be Impacted?

If the Executive Order were implemented, birthright citizenship would be limited to children with at least one parent who is either a U.S. citizen or a lawful permanent resident (green card holder).

This could affect children born in the United States where:

 

  • The mother is undocumented and the father is not a U.S. citizen or lawful permanent resident.

  • The mother holds temporary legal status and the father is not a U.S. citizen or lawful permanent resident.

 

Temporary legal status may include individuals with:

 

  • Student visas

  • Visitor visas

  • Temporary worker visas

  • Temporary Protected Status (TPS)

  • Parole status

  • Deferred action

  • Visa Waiver Program entry

  • Protection under the Convention Against Torture

  • Other temporary humanitarian protections

 

These potential changes could impact many immigrant families living and working in the United States.

If the courts determine that the Executive Order is lawful, it could significantly change how citizenship is granted to children born in the United States.

However, there are still many unanswered questions about how the order would be implemented. Government agencies, including the U.S. Department of Homeland Security, would need to establish new procedures.

  • How parents would prove eligibility for citizenship at birth

  • What immigration status affected children would receive

  • How hospitals and state agencies would issue birth certificates

  • How the Social Security Administration would process documentation for newborns

 

Because these logistical issues have not yet been addressed, the timeline for any potential changes remains unclear.
